1. Acceptance of Terms

By downloading, installing, or using Ultimate Walk-Up Music ("the App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App.

2. Description of Service

Ultimate Walk-Up Music is a mobile application that allows baseball and softball coaches to create personalized walk-up intros for their players. The App combines text-to-speech announcements with music clips to create a stadium-quality experience.

3. User Accounts

You must create an account to use the App. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to provide accurate, current, and complete information during registration.

You must be at least 18 years old to create an account. The App is designed for use by coaches and parents of youth sports teams.

4. Subscription Terms

Free Tier: The App offers a free tier with limited features (1 team, 1 player, built-in music library, on-device voice).

Pro ($4.99 one-time): A one-time purchase that unlocks unlimited teams and players, custom song uploads, and additional features.

Voice Pack ($4.99/month): A monthly subscription that provides access to premium AI announcer voices powered by ElevenLabs.

Subscriptions are managed through the Apple App Store or Google Play Store. Billing, cancellation, and refund policies are governed by the respective store's terms. Subscriptions auto-renew unless cancelled at least 24 hours before the end of the current billing period.

5. Acceptable Use

You agree to use the App only for its intended purpose — creating walk-up intros for sports teams. You agree not to:

• Use the App to create offensive, harmful, or inappropriate content
• Upload copyrighted music that you do not have the right to use
• Attempt to reverse-engineer, decompile, or disassemble the App
• Use the App's AI voice features to impersonate real individuals
• Exceed reasonable usage limits or abuse the text-to-speech services
• Share or redistribute your account credentials

6. User Content

You retain ownership of all content you create using the App, including team configurations, player data, and generated audio files. You are solely responsible for ensuring that any music you upload complies with applicable copyright laws.

The built-in music library consists of royalty-free clips licensed for use within the App. These clips may not be extracted, redistributed, or used outside the App.

7. Intellectual Property

The App, including its design, code, features, and built-in content, is the intellectual property of Ultimate Walk-Up Music and is protected by copyright and other intellectual property laws. The AI voices are provided under license from ElevenLabs and are subject to their terms of use.

8. Disclaimers

The App is provided "as is" and "as available" without warranties of any kind, express or implied. We do not guarantee that the App will be uninterrupted, error-free, or that it will meet your specific requirements.

Audio quality may vary depending on your device, the source audio files, and network conditions (for AI voice features). We do not guarantee specific audio quality or voice characteristics.

9. Limitation of Liability

To the maximum extent permitted by law, Ultimate Walk-Up Music and its developers shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from or related to your use of the App. Our total liability shall not exceed the amount you paid for the App in the 12 months preceding the claim.

10. Termination

We reserve the right to suspend or terminate your account if you violate these Terms or engage in abusive behavior. You may delete your account at any time through the App's Settings screen. Upon termination, your locally stored data will remain on your device until you uninstall the App.

11. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes through the App or by updating the "Last updated" date above. Your continued use of the App after changes constitutes acceptance of the updated Terms.

12. Governing Law

These Terms are governed by and construed in accordance with the laws of the United States. Any disputes arising from these Terms or the use of the App shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association.
